Terms & Conditions — Komfortive™ Lifestyle Private Limited

Please read these Terms & Conditions (“Terms”) carefully before using the Komfortive™ website or placing an order. By accessing or using komfortive.com and related services, you agree to be bound by these Terms and all related policies (including our Privacy Policy and Refund/Returns Policy). This agreement is an electronic contract governed by the laws of India.
1. Who Can Use the Site
You represent and warrant that you are at least 18 years old and have the capacity to enter into a binding contract, or that you are using the site under adult supervision. We reserve the right to refuse service to users under 18 who are not supervised by a guardian. You agree to provide accurate and complete information when creating an account or placing an order.
2. Account Registration
To shop on Komfortive you may be required to register an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately if you suspect unauthorized use of your account.
3. Ordering and Pricing

Product listings are subject to availability. Adding an item to your shopping cart does not reserve it. Availability is confirmed only after successful payment.

Prices are quoted in Indian Rupees (INR) and include applicable taxes unless stated otherwise. We attempt to be accurate, but if a pricing error occurs, we reserve the right to cancel the order and refund any amounts paid.

We may limit quantities of any product, and we reserve the right to refuse or cancel orders that appear fraudulent or in violation of these Terms.
4. Payment
We accept major payment methods including credit/debit cards, net banking, UPI, and Cash-on-Delivery (where available). All payments are processed through third-party payment gateways. By placing an order, you authorize us and our payment processors to charge the applicable fees to your chosen payment method.
5. Delivery

We offer delivery across India. Typical processing time is 1–2 business days after order confirmation; delivery times vary by location (usually 3–7 business days).

Shipment tracking details will be provided once your order is dispatched.

Risk of loss and title for the goods pass to you upon handover of the goods to the courier partner. Contact Customer Care for any delivery issues.
6. Cancellation, Returns & Refunds

In summary: unshipped orders can be cancelled; most delivered items may be returned within 7 days in unused condition (reverse pickup service available). Refunds are processed after we receive and inspect returned items and in accordance with the Refund Policy.
7. Intellectual Property
All content on this website — including but not limited to text, product descriptions, photographs, images, logos, graphics, and designs — is the intellectual property of Komfortive Lifestyle Pvt. Ltd. or used under a valid license, model release, or written permission. Unauthorized reproduction, modification, distribution, or transmission of any content is prohibited without our prior written consent.
We endeavour to use only images and photographs for which we hold appropriate rights, licences, or written releases from the copyright owner and the model(s). However, some images on the Site may be provided by third-party suppliers, partners, or vendors. If you are a rights-holder or representative and believe any content on our Site infringes your intellectual property or portrait rights, please contact us as described below.
IP Complaint & Takedown Procedure

If you believe that your copyrighted work or model/portrait rights have been used on the Site without authorization, please send a written notice to care@komfortive.com with the following information:
- Your name, contact information, and authority to act on behalf of the rights owner;
- Identification of the copyrighted work or image(s) you claim have been infringed;
- The URL(s) or location(s) on our Site where the material appears;
- A statement, under penalty of perjury, that you have a good faith belief the use is unauthorized; and A signed electronic or physical signature of the rights owner or authorized agent.
- Upon receipt of a valid notice, we will acknowledge receipt within 24 hours and investigate promptly. If we determine the claim is valid, we will remove or disable access to the disputed content within 48 hours and notify the complainant and the content supplier.
- If you are the supplier of the disputed content and believe the takedown was in error, you may submit a counter-notice with supporting evidence of ownership or license. We will review the counter-notice and may restore the content only after verifying the claim or if no further legal claim is made.
Supplier Warranties & Indemnity
All suppliers, photographers, agencies, and content providers who supply images to Komfortive warrant that they hold all necessary rights, releases, and licences (including model releases) to permit use by Komfortive. Suppliers agree to indemnify, defend, and hold Komfortive harmless from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from any breach of these warranties.
Rights of Komfortive™
Komfortive™ reserves the right to remove or replace any image or other content at any time, without prior notice, if we reasonably believe it infringes a third party’s rights or otherwise violates our policies. We also reserve the right to pursue legal or contractual remedies against suppliers or other third parties who provide infringing content.

8. User Conduct & Prohibited Uses
You agree not to:

9. Limitation of Liability
To the fullest extent permitted by law, Komfortive and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption arising from your use of the site or purchase of products. Our aggregate liability for any claim arising out of or relating to these Terms shall be limited to the amount paid by you for the relevant product(s).
10. Indemnity
You agree to indemnify and hold Komfortive™, its officers, employees, agents, and affiliates harmless from any claims, demands, losses, liabilities, and expenses (including legal fees) arising from your breach of these Terms or your violation of any law or rights of a third party.
11. Force Majeure
We will not be liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, strikes, pandemics, government actions, or courier disruptions. In such events, we will attempt to resume performance as soon as practicable.
12. Third-Party Links & Services
Our website may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or reliability of those third parties, and linking to them does not imply endorsement.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in — Siwan, Bihar / Patna, India.

15. Changes to Terms
We may modify these Terms from time to time. Continued use of the website after such changes implies acceptance of the revised Terms. The Last Updated date at the top will indicate the effective revision date.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
